PREAMBLE – We, the students of the University of Colorado Denver Health Science Center Downtown Denver Campus, believe all students are entitled to the rights consistent to an accessible, just, and equitable representative student government and we hereby establish and enact the Student Bill of Rights.
I. Students shall have the right to student governance as provided by the UCDDDCSGA Constitution.
II. Students shall have the right to shared participation in decision making as provided by the UCDDDCSGA Constitution.
III. Students shall have the right to petition and appear before UCDDDCSGA for all matters of governance as provided by the UCDDDCSGA Constitution.
IV. Students shall have the right to competent and just student representation in UCDDDCSGA as provided by the UCDDDCSGA Constitution.
V. Students shall have the right to due process in all disciplinary matters consistent with institutional provisions.
VI. Students shall have the right to free and independent access to UCDDDCSGA information as it pertains to matters of governance.
VII. UCDDDCSGA shall not deny students the right to assemble.
VIII. UCDDDCSGA shall not deny students the right of free speech.
IX. UCDDDCSGA shall not deny students the right to dissent and protest.
X. UCDDDCSGA shall not deny students the right to personal privacy.
XI. UCDDDCSGA shall not deny any student participation & equity in UCDDDCSGA.
XII. UCDDDCSGA shall recognize all student rights and privileges provided through the University of Colorado Denver Health Science Center Downtown Denver Campus Code of Student Conduct.
The name of this body shall be the University of Colorado Health Science Center Downtown Denver Campus Student Government Association, hereinafter referred to as University of Colorado Denver Student Government Association (UCDSGA) and Colorado University Denver Student Government Association (UC Denver Student Government Association).
The purpose of the UC Denver Student Government Association will be to represent and promote the ideas and interests of the student community while providing opportunities for student leadership and student leadership development.
ARTICLE III ELIGIBILITY
A. Admission Status
UCDSGA shall consist of UC Denver undergraduate students registered for a minimum of six (6) credit hours and graduate students registered for a minimum of three (3) credit hours, for credit, for the current semester, and during each fall and spring semester thereafter. To continue in Student Government, at-large students and school or college representatives must be admitted to a degree program within one academic semester of election or appointment to membership of the UC Denver Student Government Association. All school or college representatives must be accepted and admitted in a school which they represent. All members of Student Government must pay all mandatory student fees for each fall and spring semester.
B. Academic Standing
All members of UCDSGA must be in good academic standing as currently defined by the University of Colorado Denver Health Science Center Downtown Denver Campus. Undergraduates must maintain a cumulative 2.0 GPA; graduates must maintain a cumulative 3.0 GPA.
C. Position
No student may occupy more than one position in UCDSGA concurrently whether elected, appointed, or staff positions. Appointments for student representation on AHEC, tri-institutional sub-committees, and CU System committees are excluded.
D. Club Affiliations
No member of UCDSGA may hold an officer position on any UC Denver student club or organization recognized by UCDSGA. All members must disclose any and all affiliations with UC Denver student clubs or organizations and/or fee receiving departments.
E. Violations
Any violations of eligibility requirements shall be grounds for removal by two-thirds (2/3) vote.
ARTICLE IV – EXECUTIVE COUNCIL
A. Membership
The Executive Council shall consist of twenty (20) members with two (2) ex-officio members. Members shall serve a one-year term to begin June 1 and end May 31.
B. President and Vice President
Two (2) representatives of the Executive Council shall be elected by voting members of the student body during the General Election in the spring semester to serve as the UCDSGA President and Vice President with voting rights during Executive Council which shall be retained to the Vice President as the chair of the Executive Council is the President. In the event that Executive Council is chaired by the Vice President, the Vice President shall than distain from being included as a voting member. The President and Vice President shall be limited to serve a maximum of two elected terms in each position.
C. S.A.C.A.B.
Two (2) ex-officio non-voting members of the Executive Council shall be elected during the General Election in the spring semester to serve as UC Denver SACAB (Student Advisory Committee to the Auraria Board) representatives. SACAB representatives must meet eligibility requirements outlined in the Colorado State Statues and the UCDSGA Constitution.
D. Senators
Seven (7) at-large senators shall be elected as voting members of the Executive Council by voting members of the student body during the General Election in the spring semester.
E. Finance Board
Four (4) members of Executive Council shall be elected during the General Election in the spring semester to represent the Finance Board as voting members of the Executive Council.
F. S.O.F.A.
Seven (7) members shall be elected as non-voting members of the Executive Council by voting members of the student body during the General Election in the spring semester to represent UC Denver schools and colleges on the Student Organization Funding Assembly (SOFA): (1) School of Education (2) College of Liberal Arts and Sciences (3) College of Business and Administration, includes Graduate School of Business (4) Graduate School of Public Affairs (5) School of Architecture and Planning (6) College of Engineering and Applied Sciences (7) School of Arts and Media.
G. Duties and Responsibilities
Shall include, but not be limited to the following:
1. The Executive Council shall elect by a majority vote approval of officers from within its membership to serve as chairpersons of the following subcommittees: Legislative Committee and Public Relations Committee.
2. UC Denver representatives elected to SACAB are ineligible to serve as a chairperson of a standing committee within the Executive Council. The Finance Board Chair must be chosen from within its own membership.
3. The Executive Council shall approve all job descriptions beginning of each term in office.
4. The Executive Council shall approve the UCDSGA Student Fee Funding Policies by a two-thirds (2/3) vote.
5. The Executive Council shall approve all bylaws detailing the functions and operations of the Executive Council, all standing committees, and the Finance Board. Executive Council bylaws must be approved within six (6) weeks after the start of the elected term in office.
6. The Executive Council sets a dollar figure above which any allocation approved by the Finance Board must also be approved by the Executive Council.
7. All appointments to applicable UC Denver, CU System, and AHEC committees that are made by the UCDSGA President require a majority vote by the Executive Council.
8. All agreements within the CU System, UC Denver, and AHEC entered into by the UCDSGA President on behalf of UCDSGA require approval by a majority vote of the Executive Council.
9. The Executive Council shall enact legislation, resolutions, and initiate referendums as deemed necessary to execute the foregoing powers of the Executive Council and all standing committees.
10. The Executive Council shall reserve the authority by two-thirds (2/3) majority vote to override and finalize all decisions approved by the UCDSGA President, Vice President, standing committees, or Finance Board.
11. All requests for increased funding in the University of Colorado Denver Student Fee Budget must be approved by a two-thirds (2/3) vote of the Executive Council.
12. The Executive Council shall review, ratify, and recommend, to the Board of Regents, approval of the University of Colorado Denver Student Fee Budget by a two-thirds (2/3) vote.
H. Executive Council Meetings:
1. When school is in session, meetings shall be held at least twice per month, or more often as deemed necessary by the President.
2. Meetings must be presided over by the Executive Council President, Vice President, or Legislative Chair.
3. A quorum must be present to conduct business and shall consist of greater than one-half (1/2) of the current Executive Council voting membership (with a ‘full’ voting council, ½ = 6).
4. Minutes for all Executive Council meetings must be accurately recorded and maintained. Said minutes must be on file and available for public inspection. Minutes from closed executive sessions are excluded.
5. Any member of the UCDSGA Executive Council who has more than one (1) unexcused or two (2) excused absences in a semester shall be subject to removal by a two-thirds (2/3) majority vote of the Executive Council. This includes absences from Student Open Sessions.
6. All requests for excused absences must be approved by a majority vote of the Executive Council.
I. Executive Council Vacancies:
1. If a vacancy occurs among the at-large representatives, the UCDSGA President shall appoint a replacement representative subject to a two-thirds (2/3) vote of the Executive Council.
2. If a vacancy occurs among the college/school SOFA representatives, the UCDSGA President shall, in conjunction with a recommendation from the SOFA Chair, appoint a new representative subject to a two-thirds (2/3) vote of the Executive Council. In the event that the vacancy occurs and Executive Council is not meeting than the Finance Board has the authority to recognize and approve a new representative.
3. Upon resignation or impeachment and/or subsequent removal of the Executive Council President, the Executive Council Vice President shall assume the position of the Executive Council President.
4. If a vacancy occurs in the office of the Executive Council Vice President, the Executive Council shall elect, by two-thirds (2/3) vote, a replacement from within its membership to fill the vacancy for the remainder of the term in office.

ARTICLE V PRESIDENT AND VICE PRESIDENT
A. Duties and Responsibilities of the UCDSGA President
Shall include, but not limited to the following:
1. The President shall serve as chairperson of the UCDSGA Executive Council.
2. The President shall be the chief spokesperson for UCDSGA and the UC Denver student community.
3. The President, in conjunction with the Executive Council, shall oversee and maintain close supervision of the UCDSGA Student Fee Budget.
4. The President may not enter into contractual obligations within the CU System, UC Denver, and AHEC without a two-thirds (2/3) vote approval by the Executive Council.
B. Duties and Responsibilities of the UCDSGA Vice President
Shall include, but not limited to the following:
1. The Vice President shall serve as Vice Chair of the Executive Council and shall assist the UCDSGA President, in conjunction with the Executive Council, in overseeing and maintaining close supervision of the UCDSGA Student Fee Budget.
2. Responsible for chairing and organizing focus groups, open forums on issues related to student fees, University Policy issues, and Student Open Session meetings.
ARCTICLE VI THE JUDICIAL COUNCIL
A. Structure
1. The Judicial Council shall be composed of three (3) UC Denver students. One (1) elected Chief Justice and two (2) appointed justices serving for a one (1) year term to begin June 1 and end May 31. They are to be appointed by the Chief Justice and UCDSGA President with the advice of the Executive Council and ratified by a two-thirds (2/3) vote of the Executive Council.
2. The Chief Justice of the Judicial Council shall be elected by voting members of the student body during the General Election in the spring semester.
3. A quorum must be present to conduct business; quorum shall consist of all three (3) Justice’s.
4. The Chief Justice shall preside over all Judicial Council Meetings.
5. The Judicial Council shall meet as deemed necessary by the Chief Justice with at least one (1) meeting each month. (Refer to Judicial Council Rules and Procedures for exclusions during the summer term.)
B. Areas of Jurisdiction/Appeals
1. The Judicial Council shall render judgment in accordance with the UCDSGA Constitution on questions of interpretation of all policies that regulate the operations of UCDSGA legislation, Constitution, Bylaws, and Job Descriptions when such questions are submitted by any registered UC Denver student.
2. The Judicial Council shall render judgment in accordance with current UCDSGA policies and the UCDSGA Constitution on all appeals brought forth by any UC Denver student.
3. The Judicial Council, in cooperation with the Vice Chancellor for Academic Affairs, shall establish a Student Code of Conduct to set guidelines for disciplinary hearings for violations of academic honesty.
4. All Judicial Council interpretations shall be valid and binding on all parties.
5. The Executive Council shall initiate measures with the expedience to execute all Judicial Council rulings.
C. Duties and Responsibilities
Shall include, but not limited to the following:
1. All Judicial Council members must sit on at least one (1) campus committee.
2. Shall monitor process for resolution of student academic grievances when such request is made by student or faculty.
3. The Judicial Council shall participate in student disciplinary hearings in accordance with University Policy & Procedure.
4. The Chief Justice shall monitor & guide students through grievance proceedings.
5. An oath of office will be administered by the current Chief Justice at the beginning of the elected/appointed term for all Executive Council members. The oath is as follows:
“I,____________, (name) swear to uphold the UCDSGA Constitution, By-Laws, and fulfill applicable job description; to serve the student body as their voice and representative to the best of my ability; to be honest and uphold the integrity of the University of Colorado Denver and its students.”
ARTICLE VII STUDENT ADVISORY COMMITTEE TO THE AURARIA BOARD (SACAB)
1. UC Denver students serving as representatives to SACAB (Student Advisory Committee to the Auraria Board) must meet the eligibility requirements as outlined in the Colorado State Statutes.
2. All proposed changes in eligibility requirements for UC Denver representatives set forth by SACAB must be approved by a two-thirds (2/3) majority vote of the UCDSGA Executive Council.
3. UC Denver representatives elected to SACAB are ineligible to serve as chairperson of a standing committee within the UCDSGA Executive Council.
ARTICLE VIII STANDING COMMITTEES
A. Structure
A system of Executive Council Standing Committees shall include, but not limited to, 1) Legislative Committee & 2) Publications/Public Relations Committee.
1. Membership to each Executive Council standing committee shall be limited to five (5) voting members.
2. A quorum must be present to conduct business. Quorum shall consist of three (3) voting members.
3. The term of each standing committee member, including the chairperson, shall be until the end of the elected term in office (June 1 to May 31).
4. All subcommittees are prohibited from approving any budget request rejected by the Executive Council.
5. All standing committees must maintain minutes of meetings. Said minutes must be made available and on file for public inspection.
6. All standing committee chairs must file a monthly written report to the Executive Council to update the Council on the activities of the committee.
7. All standing committees must establish committee bylaws pending two-thirds (2/3) vote approval of the Executive Council.
B. LEGISLATIVE COMMITTEE
The duties of the Legislative Committee shall include the following:
1. The chairperson of the Legislative Committee shall serve as the parliamentarian for the UCDSGA Executive Council.
2. Shall establish bylaws, rules, and procedures for the Executive Council. All policies approved by the Legislative Committee must be approved by a two-thirds (2/3) vote of the Executive Council.
C. PUBLICATIONS/PUBLIC RELATIONS COMMITTEE
The duties of the Publications/Public Relations Committee shall include the following:
1. Preparation of the UCDSGA newsletter or equivalent on a monthly basis for publication, coordinate the distribution and posting on the North Classroom Bulletin Board and UC Denver Student Government Association website.
2. Coordinate with the student newspaper for advertisements and official UCDSGA statements.
A. Structure
1. A total of five (5) members shall serve as the UCDSGA Finance Board. Four (4) members will be elected through General Elections; the fifth shall be the UCDSGA President who serves as the Vice-Chair.
2. The Chair of the Finance Board shall be elected from within the Finance Board membership by Executive Council.
3. Finance Board quorum shall consist of three (3) members. In the event that quorum does not exist, all business shall be brought to Executive Council.
B. Duties and Responsibilities
1. Shall establish UCDSGA Funding Guidelines and Procedures in conjunction with the SOFA for the allocation of student fee funds to UC Denver student organizations. All policies established by the Finance Board must be approved by a two thirds (2/3) vote of the Executive Council.
2. Shall recognize UC Denver student clubs/organizations.
3. Shall establish and recommend for approval to Executive Council, the UCDSGA Discretionary Funding Requests within priorities established by the Executive Council.
4. Shall exist to administer and monitor student fee policies within priorities established by the Executive Council.
5. Shall submit a financial statement each month to the Executive Council which must outline all student fee expenditures allocated by the Finance Board and all UCDSGA accounts.
6. All decisions of the Finance Board may be appealed to the Executive Council. See Funding Guidelines and Procedures.
7. Finance Board shall be consistent with the University Fiscal policy, UC Denver Institution Plan for Student Fees, UCDSGA Constitution, and the Executive Council Bylaws and Job Descriptions.
8. Finance Board shall appropriate a budget to the Student Organization Funding Assembly (SOFA). The SOFA shall be solely responsible for allocation of said funds to student clubs and organizations.
C. Vacancies
1. Chair – in case of impeachment, removal, or resignation, a current Finance Board member will be appointed by the UCDSGA President to the Chair position.
2. Members – in the case of a vacancy, the UCDSGA President will appoint a new Finance Board member.
ARTICLE X STUDENT ORGANIZATION FUNDING ASSEMBLY (SOFA)
A. Structure
1. The SOFA shall be recognized by the Finance Board..
2. The SOFA shall be governed by a Constitution that is established and amendable by a two-thirds (2/3) majority vote of the Executive Council.
3. A total of seven (7) voting at-large members serve as the Student Organization Funding Assembly (SOFA) subject to the requirements stipulated by Article III of this Constitution.
4. All SOFA decisions may be reviewed and overturned by two-thirds (2/3) majority vote of the Judicial Council.
5. Student clubs and organizations who wish to appeal a SOFA decision shall make appeals to the Judicial Council for a two-thirds (2/3) vote approval.
6. In the event a SOFA decision is repealed or overturned, the funding proposal must be returned to SOFA for a reconsideration based on the ruling of the Judicial Council.
B. Duties and Responsibilities
1. The SOFA shall be responsible for maintaining the SOFA Funding Guidelines and Procedures in conjunction with the Finance Board.
2. All funding for student clubs and organizations from the SOFA budget shall be allocated by the SOFA.
3. Any money not allocated/distributed by SOFA at the end of the current fiscal year (June 31st), shall be returned to the Finance Board for re-appropriation.
4. The SOFA members may choose representatives to serve on the Student Fee Review Committee as voting at large members.
C. Vacancies
1. In the event of a vacancy on the SOFA, the SOFA Chair will solicit the college to produce a new candidate for recommendation to the President for appointment subject to a two-thirds (2/3) vote approval of the Executive Council.
2. In the event that there are not enough SOFA members for quorum, members of the Finance Board may sit on the SOFA so that the SOFA meeting can be held.
ARTICLE XI STUDENT FEE REVIEW COMMITTEE
A. Shall be according to the current Revised Institutional Plan for Student Fees.
B. Student representatives will sit on the Student Fee Review Committee. The student representatives will be the UCDSGA President, Finance Board Chair and at large members of the student body.
C. A student committee may be established by the student fee review committee for the purpose of reviewing proposed fees.
ARTICLE XII STUDENT FEE POLICY
A. Student Fee Guidelines
1. The Constitution shall be supplemented by UCDSGA Funding Guidelines and Procedures approved by the UCDSGA Executive Council.
2. All student fee policies and expenditures must comply with Federal and State laws, as well as policies set forth by the Board of Regents
3. The Executive Council shall insure that the above is carried out based on guidelines stated in printed student fee funding policies approved by the UCDSGA Executive Council.
4. All information concerning student fee policies and expenditures must be on file and available for public inspection.
B. Student Government Budget
1. The UCDSGA President, in conjunction with the Chair of the Finance Board, must sign funding approval voucher’s to authorize the processing of any expenditures involving the allocation of fees from Student Government budgets and accounts.
NOTE: The UCDSGA President or the Chair of the Finance Board does not reserve the authority to refuse to sign off on expenditures approved by the appropriate branches of UCDSGA unless the expenditure is proved to be in violation of student fee, University, or UCDSGA policies.
2. UCDSGA cannot exceed the spending of its annual Student Fee Budget allocated and approved by the Board of Regents.
ARTICLE XIII SOFA CONSTITUTION
This Constitution shall be supplemented by the SOFA Constitution.
ARTICLE XIV SOFA FUNDING GUIDELINES & PROCEDURES
This Constitution shall be supplemented by the SOFA Funding Guidelines & Procedures.
ARTICLE XV REVISED INSTITUTIONAL PLAN FOR STUDENT FEES
This Constitution shall be supplemented by the current Revised Institutional Plan for Student Fees.
A. This Constitution shall be supplemented by the bylaws of the following UCDSGA branches: Executive Council, Executive Council Standing Committees, Finance Board, and the Judicial Council.
B. In the event that the said bylaws conflict with the provisions in the UCDSGA Constitution, they must be rewritten in accordance with the Constitution.
ARTICLE XVII JOB DESCRIPTIONS
The Constitution shall be supplemented by the UCDSGA Job Descriptions. See also Article IV Sec. G, Subpart 2.
ARTICLE XVIII REMOVAL AND RECALL
A. Removal:
1. All elected or appointed members of the UCDSGA serving on the Executive Council or Judicial Council are subject to removal from their position by impeachment proceedings. Any member of UCDSGA may initiate proceedings with verification of allegations of misconduct.
2. Grounds for impeachment or removal shall be failure to fulfill the duties of the position, including any violation of student fee policies, UCDSGA Constitution, Bylaws, or Job Descriptions.
3. Prior to impeachment proceedings, the individual subject to removal must be notified in writing by the Director of Student Life of all allegations of misconduct.
4. Two-thirds (2/3) vote of Executive Council is required for removal from office.
5. Attendance is not an impeachable offence, but sufficient grounds for removal.
B. Recall:
1. The recall of an elected member of UCDSGA may be initiated by a petition containing signatures of at least five percent (5%) of the enrolled, voting, and fee paying CU Downtown Denver Campus population. Signatures must be verified by the Director of Student Life.
2. Recall procedures cannot be instituted until at least three (3) months after the start of the elected term of office.
3. A two-thirds (2/3) vote is required for recall.
4. If the individual is recalled, vacancies shall be filled in accordance with the provisions in Article IV, Section I and Article IX, Section C of this Constitution.
5. All recall proceedings shall be presided over by the UCDSGA Chief Justice.
ARTICLE XIX STUDENT OPEN SESSION
A. Structure
1. The Vice President of the Executive Council shall serve as the Chair of all meetings.
2. Meetings are to be held a minimum of twice (2) a semester and shall be open to all members of the campus community.
3. See Article IV – Executive Council, Section I – Executive Council Meetings, Subpart 5.
A. UCDSGA General Elections shall be held once each year in the spring semester during March unless otherwise deemed necessary by the Executive Council.
B. In the event that a Special Election is held, deadlines for Executive Council approval of an Election Commissioner, budget, and the election code, may be waived by a two-thirds (2/3) majority vote of the Executive Council.
C. The UCDSGA Elections shall be overseen by the UCDSGA Election Commissioner.
1. The Election Commissioner shall be appointed by the UCDSGA President from the registered UC Denver student community and ratified by a two-thirds (2/3) vote of the Executive Council. The Election Commissioner must be approved by the Executive Council by the second week of Spring Semester.
2. The UCDSGA Election Commissioner shall serve for a one (1) year term.
3. The Election Commissioner may modify and shall implement an election code which must outline all of the information concerning rules, procedures, and deadlines for the General Election. The election code must be ratified by a two-thirds (2/3) vote of the Executive Council no later than three (3) weeks prior to the election.
ARTICLE XXI AMENDMENT AND REFERENDUM PROCEDURES
A. All UC Denver students shall have the power to enact amendments and measures by referendum. Measures passed by referendum shall have the same authority and force as any measures passed and approved within the Executive Council.
B. A referendum or amendment shall consist of a single question, appropriately validated in accordance with the provisions set forth in the Constitution and the UCDSGA Election Code and placed on the ballot, where students may vote “yes” or “no”.
C. All petition-initiated referendum or amendment questions must be submitted to the Election Commissioner on or before the deadline set forth by the commission in the Election Code. Any petition turned in after the deadline shall be VOID.
D. Procedure to place a referendum or amendment question on the ballot requires the following:
1. The referendum must have the exact wording of the referendum question on the same sheet of paper on which signatures are being taken.
2. Signatures of five percent (5%) of the enrolled, voting, fee paying, UC Denver student population shall be necessary to put each referendum question on the ballot. Student signatures must include their student numbers and shall be verified by the Office of Student Life.
3. All referendum questions must be publicized in the Student Newspaper by the Election Commissioner.
4. To pass in popular vote, the referendum must be approved by a majority vote of UC Denver voting students.
5. Upon passage, amendments must be attached/placed into the Constitution.
6. Any referendums or initiatives pertaining to the UC Denver student community initiated by SACAB must first be approved by a two-thirds (2/3) vote of the Executive Council before going to the vote of UC Denver students.
E. Amendment or referendum questions initiated by the Executive Council require an approval of two-thirds (2/3) vote by the Executive Council. Student Fee referendum questions may be initiated by: petition, Executive Council, and/or the UCDDDC Chancellor.
F. All Student Fee Referendum questions must comply with the UC Denver Institutional Plan on Student Fees.
ARTICLE XXII DISCRIMINATION
Discrimination on the basis of race, gender, creed, color, national origin, disability, or sexual orientation, by any individual or unit of UCDSGA, is prohibited. A cause of action is created under this article for any individual who feels that he/she has bee discriminated against in violation of this article. The Judicial Council shall have jurisdiction to hear complaints under this article as the forum of first resort. Any persons found guilty of violating this article in proceedings by the Judicial Council shall be immediately removed without pay until such time as a final judgment is rendered in accordance with University procedure.
ARTICLE XXIII TRANSITION PROVISION FOR THIS CONSTITUTION
Ratification to this Constitution shall have taken place on an affirmation vote by a majority vote of UC Denver students voting during and following official sanction of the Constitution. When ratified, the provisions set forth in this Constitution will supersede all previous UCDSGA and current student Constitutional documents.
